BDK Attorney’s family law department is once again deemed successful across the nation in the fight for the best interests of minor children.
Our Director Mrs Amorette Gangel, together with Advocate Roxanne Adams of the Johannesburg Bar, were successful in the Kimberley High Court, whereby an Order was made granting interim relief in terms of Rule 43 where a minor child was the victim of medical negligence by their own parent. The father of the minor child also failed to adequately maintain the financial needs of the minor child. BDK Attorneys brought this Rule 43 Application subsequent to the minor child returning to our client’s care in an extremely neglected state.
It was argued that same parent had continuously failed and neglected to satisfy the basic and financial needs of the minor child. Our client and her minor child have suffered immensely at the hands of the biological father – conduct which the Court would not condone.
The Court made an Order to limit the biological father’s contact rights, pending the outcome of several investigations, as well as ordering the father to adequately provide for the financial needs of the minor child (which he had not done for several years). BDK Attorneys walked away with every prayer sought in our Notice of Motion being made an Order of Court, including an appropriate Order for costs.
