On 20 December 2022, BDK Attorneys Director Ulrich Kruger and Candidate Attorney Jacques Peacock, with Advocate Anmarli van der Merwe on brief, ensured the protection of our client’s interests and rights, especially in respect of the provision of electricity to our client’s business premises.
The City of Johannesburg erroneously and negligently disconnected the electricity supply to our client’s business premises. Our client, who is in the information technology and intelligence sphere and provides services on a national level, requires electricity for the provision of their services.
The City of Johannesburg served our client with an electricity disconnection notice, however, the notice was intended for a different property located close to our client’s premises. After the City of Johannesburg admitted to the error on two occasions, but still failed to rectify the situation, and failed to respond to a Letter of Demand, BDK Attorneys had no choice but to approach the Johannesburg High Court on an urgent basis.
The City of Johannesburg, in a feeble attempt, proceeded to oppose the matter. Save to say that their opposition was baseless and the electricity supply to our client’s property was restored prior to the hearing. BDK Attorneys persisted in the hearing of the matter and successfully obtained a punitive costs order against the City of Johannesburg as between attorney and own client.
