In a stunning turn of events, BDK Attorneys has secured a monumental triumph for justice and the rule of law. The court’s judgment echoed the words of the Supreme Court of Appeal in S v Lubaxa 2001 (2) SACR 703 SCA: “I have no doubt that an accused person is entitled to be discharged at close of the case for the prosecution if there is no possibility of a conviction other than if he enters the witness box and incriminates himself.”
