BDK Remains Determined To Defend The Underdog

Practicing Consultant, Jannie Kruger, once again proved that no matter the odds, BDK Attorneys will fight tooth and nail for the underdog.

In a recent victory in the Supreme Court of Appeal, Jannie Kruger ensured that a client was acquitted after being convicted and sentenced. This battle to ensure the client’s freedom has been ongoing since 2016.

On 14 November 2017, BDK’s client was found guilty by the late Honourable Judge Monama on seven counts, including two counts of murder, three counts of attempted murder and two counts relating to the possession of an unlicensed firearm and ammunition.

On 29 March 2018, BDK’s client was sentenced to life imprisonment which meant that the client would only be eligible for parole after serving a period of 25 years in prison.

After leave to appeal was refused by Monama J, BDK Attorneys petitioned to the Supreme Court of Appeal, who granted leave to the Full Bench of the High Court. The Full Bench of the High Court dismissed the appeal on 2 September 2021.

Jannie Kruger did not leave the fight for justice there and again petitioned to the SCA. Although almost unheard of, the SCA granted leave to appeal for a second time, thereby permitting the client to appeal to the SCA itself. This appeal was heard on 7 November 2022.

In a scathing judgment by the SCA, with all five Justices concurring, it was held that this matter is one that was “badly investigated and badly prosecuted”. Consequently, the appeal was upheld, and the conviction and sentence were set aside. The SCA lambasted State’s and High Courts’ utter disregard for the appellant’s alibi. The SCA also found that the State Witnesses were not credible and no weight ought to have been attached to their evidence.

BDK’s client is now a free man after being in custody for more than five years. Despite having been pushed from pillar to post in the various appeals, Jannie Kruger remained determined to ventilate the truth, prove the client’s innocence on the basis of his alibi and to fight for the underdog.
