Litigation Victory: BDK Attorneys Secures Decisive Courtroom Victory for Elderly Client in Serious Criminal Matter

BDK Attorneys is proud to announce a significant success in a criminal matter involving an elderly client who faced serious charges dating back to 2020. The case, handled by newly admitted Associate Chamonay Grobler resulted in the client being acquitted on the most serious counts after a rigorous and strategically executed defence.

The client, an elderly man with no prior convictions, was charged with:

  1. Assault by way of threat;
  2. Unlawful possession of a firearm; and
  3. Failure to store lawfully licensed firearms in a prescribed safe, as required under South African law.

At the time BDK Attorneys was instructed, the matter was already in the trial phase, and the client had pleaded not guilty to all charges. Prior representation by an advocate had left the client dissatisfied and anxious—particularly in light of the second charge, which carries a mandatory minimum sentence of 15 years’ direct imprisonment.

Recognising the gravity of the charges, BDK Attorneys undertook a comprehensive review and reformulation of the defence strategy.

Grobler performed an extensive reassessment of the State’s evidence. She proceeded to cross-examine the complainant, exposing material inconsistencies that undermined the credibility of his version. The State subsequently led evidence from four police officers. During cross-examination, Grobler correctly identified and highlighted several failures on their part to discharge their duties as police officers of the Republic of South Africa. These included procedural irregularities, investigative shortcomings, non-compliance with firearm-handling requirements, and evidentiary gaps that casted doubt on the integrity of the State’s case.

Grobler’s cross-examination significantly weakened the State’s version and shifted the evidentiary balance in favour of the defence.

Judgment: Court Finds the Defence’s Version More Probable

In delivering judgment, the Court held that the State had failed to prove its case beyond reasonable doubt in respect of Charges 1 and 2. The Magistrate placed particular emphasis on the evidentiary deficiencies uncovered during cross-examination, the inconsistencies in the State’s case, and the strength, coherence, and credibility of the defence’s version.

The Court expressly found that the defence had rightfully created reasonable doubt, and on the totality of the evidence, it was more probable that the defence version was correct than the version presented by the State.

The client was acquitted on Charge 1: Assault by way of threat; and acquitted on Charge 2: Unlawful possession of a firearm, thereby avoiding the mandatory 15-year imprisonment term attached to that offence. He was convicted only on Charge 3, relating to the improper storage of firearms—a regulatory offence with far less serious consequences.

Sentencing: Defence Successfully Preserves Client’s Firearm Fitness

Following the verdict, the State sought an order declaring the client unfit to possess a firearm, which would have resulted in the loss of all nine (9) lawfully licensed firearms in his possession.

Grobler advanced a comprehensive and persuasive argument, submitting that the client’s firearm licences were lawfully obtained and valid, the conviction pertained solely to storage, not to unlawful possession or misuse, and it would be unjust and disproportionate to deprive him of his rights on the basis of a single regulatory non-compliance.

The Court agreed entirely with these submissions and refused to declare the client unfit to possess a firearm. All existing firearm licences remain intact.

This matter represents a clear demonstration of the value of meticulous preparation, targeted cross-examination, and strategic advocacy.
