Year In Review & This Coming Year – Rita Moodley

Taking stock in March. Unusual, yes, but then there is that motto of ours:  WHAT MAKES US DIFFERENT MAKES US BETTER.

Defending Rights And Restoring Futures

Our firm has successfully defended clients in matters involving fundamental constitutional rights, including the right to privacy, the rights of arrested and accused persons, the right to bail, and the right to a fair trial. With extensive experience in constitutional and criminal litigation, we are well equipped to challenge unlawful arrests, warrantless searches and seizures, and to protect our clients’ privacy rights in accordance with the law.

Some Of Our Notable Successes & Case Studies:

Here is a brief review on a year defined by tenacity, tireless advocacy and victories.

  • Gender Based Violence (including domestic violence) and Harassment and Intimidation
    • Gender-Based Violence allegations (including that of Protection orders for Domestic Violence and Protection from Harassment) carry a unique social stigma that can jeopardize a person’s career and reputation long before a court issues a ruling. In 2025, our firm dealt with these matters by focusing on due process and evidentiary integrity.
    • Where to from here? Cyber stalked? Social media hacked? How to protect your parental, professional and public standing during and after the legal process? How to deal with the after effect of being victimized or villainized?

  • Murder and Attempted Murder
    • We help navigate the complexities of evidence and ensure due process is followed. Our work includes the review of evidence including providing merit opinions and challenging the evidence. The presumption of innocence is a cornerstone in criminal law and we ensure that the State meets its burden of proof.

  • Guilty Pleas and Convictions
    • When the facts are unfavourable and a plea is the best strategic move, we humanize our client in a system that sees them as a case number or a statistic.
    • Our firm successfully negotiated and facilitated several sentence and plea agreements with the State’s prosecution including favourable argument in mitigation. We believe that in certain instances, the interests of justice are better served through rehabilitation and restorative justice rather than a punitive prison sentence.

  • Representations with Prosecution
    • We have successfully attended representations on behalf of our clients wherein criminal prosecution, and criminal trials were averted, usually prompted by representations to challenge the lack of evidence, procedural errors, or violated rights.
    • Under certain circumstances our clients were successfully enrolled in Diversion programs. In certain instances, and depending on the merits of a matter, a rehabilitative route for our clients was successfully negotiated. Our clients saved on litigation costs whilst the judicial system saves court resources

  • Pre-Trial Interventions and/or Pre-Trial Dismissals
    • There are various instances in which a pre-trial intervention may call for the dismissal of a case. We analyse the merits of a matter to determine whether it is in the interests of justice to pursue a matter. In this regard, our firm has where possible, successfully used alternative dispute resolution and mediation to resolve matters.

Looking Ahead to 2026

As we are well on our way into 2026, we remain committed to defending the presumption of innocence.

Our individual clients can expect the same level of tenacity and innovation (and BETTER) that defined our success in 2025. We are familiar with the collateral damage associated with criminal charges and its impact.

Our focus remains balancing sensitivity with rigorous advocacy!

Our corporate clients can depend on our insight and support to navigate challenges and receive strategic advice and support with Criminal matters, Criminal and Ethics investigations, Risk Management, Regulatory Compliance including conducting of Internal Investigations, to self-correct before reaching the courtroom.

Our firm will continue to strive and bridge the gap between defending the individual and protecting business enterprises. The stakes are always high whether our client is the layman or the CEO. We strive to provide the same high-level legal, forensic service including IT and investigative resources.
